A three-judge panel of Trump appointees on the U.S. Court of Appeals for the D.C. Circuit — including Gregory Katsas and Neomi Rao, both veterans of Trump's first administration — denied Anthropic's emergency motion to block the Pentagon's blacklisting of its Claude AI models. The Pentagon had designated Anthropic a supply chain risk to national security, requiring defense contractors to certify they do not use Claude in their military work — a dispute rooted in the DOD's demand for unfettered access to Anthropic's models for all lawful purposes, while Anthropic sought assurances its technology would not be used for fully autonomous weapons or domestic mass surveillance. With opposing rulings from the D.C. Circuit and a separate San Francisco federal court that had granted Anthropic a preliminary injunction, Anthropic remains blocked from DOD contracts but can continue working with other federal agencies while the cases proceed.
